Fed: PM says federal stem cell law would prevail

Prime Minister JOHN HOWARD says he believes any federal legislation on stem cell researchwill have precedence over state laws.

Mr HOWARD yesterday wrote to premiers proposing the commonwealth and states allow surplusIVF embryos to be used for stem cell research.

But the premiers say the proposal doesn't go far enough and have foreshadowed lawsof their own to clear the way for the therapeutic cloning of embryo stem cells.

However, Mr HOWARD says if there is federal legislation and state legislation in thesame area, the federal legislation takes precedence.

Mr HOWARD told radio 3AW he doesn't want to get into a constitutional wrangle withthe states and would rather talk the matter through.
